This website and online store are operated by Jewelry Design House by Jivan. Throughout these Terms, “we,” “us,” and “our” refer to Jewelry Design House by Jivan.

We provide this website, including its information, content, features, tools, products, and services (collectively, the “Services”), through an online store powered by Shopify.

These Terms of Service (“Terms”), together with the policies referenced in them, govern your access to and use of the Services, including purchases from our store. Please read them carefully before using the Services or placing an order.

By accessing or using the Services, you agree to these Terms to the extent permitted by applicable law. If you do not agree, you should not use the Services.

Our collection and use of personal information are described in our Privacy Policy.

Nothing in these Terms excludes or limits any consumer right, legal warranty, remedy, or protection that cannot lawfully be excluded or limited.

Access and Account

You must be at least the age of majority in your place of residence to place an order or create an account.

When making a purchase or creating an account, you agree to provide accurate, current, and complete information, including your contact, billing, payment, and shipping details. You must be authorized to use the payment method you provide.

If you create an account, you are responsible for keeping your login credentials secure and for activity you authorize through your account. Please contact us promptly at info@jivancollection.com if you suspect unauthorized access.

You may not sell, transfer, or assign your account to another person.

Our Products

Our jewelry is made to order. Please review the materials, gemstone details, dimensions, sizing options, and production information on the product page before placing your order.

We aim to present our jewelry accurately through product descriptions and photographs. Colours and appearance may vary depending on screen settings and lighting. Images may be enlarged to show detail, so please refer to the measurements and specifications in each product description.

Natural gemstones may vary in colour, inclusions, and other characteristics. These variations do not remove our obligation to supply jewelry that conforms to its description and the specifications agreed for your order.

If you have questions about a piece, its sizing, or its expected completion time, please contact us before purchasing.

We may update product listings, discontinue designs, or limit quantities or sales destinations. These changes do not alter the agreed specifications of an existing order or affect your rights under applicable law.

Orders and Payment

Before submitting your order, please review the selected products, materials, sizes, quantities, shipping address, and total charges. You authorize us and our payment providers to process payment for the amount shown at checkout.

We will send an order confirmation using the email address provided. Order acceptance and contract formation are subject to applicable law. Nothing in these Terms postpones the formation of a contract where applicable law provides that it has already been concluded.

Payments are subject to authorization and verification. We may contact you if additional information is reasonably needed to verify an order or resolve a payment issue. Please do not send full payment-card details by email.

If a payment problem, material shortage, suspected fraudulent transaction, or other issue affects our ability to fulfil your order, we will contact you to explain the situation. Any refusal, cancellation, or proposed change will be handled in accordance with applicable law. If an order is lawfully cancelled, we will refund the amounts due within the applicable legal timeframe.

Purchases through our online store are intended for personal or household use. Please contact us before placing an order for commercial resale.

Made-to-Order Production

Production times vary by product type, typically taking 7–10 business days or 2–3 weeks. The applicable production timeframe is stated on the product page.

Production time is additional to shipping time. Selecting express shipping does not shorten the production timeframe for your jewelry.

If you need your jewelry for a particular occasion, please contact us before purchasing so we can discuss the expected timeframe.

If a production delay affects your order, we will contact you with an update and provide any options or remedies required by applicable law.

Bespoke and Personalized Orders

For bespoke and personalized work, the design, materials, price, payment arrangements, and estimated completion time will be set out in our written correspondence or proposal for your order.

Please review these details carefully and raise any questions before approving the design or authorizing production.

Changes requested after approval may affect the price and completion time. We will communicate any proposed adjustments for your agreement before proceeding with the changes.

Bespoke and personalized pieces are excluded from our voluntary return and exchange policy. This exclusion does not limit any legal warranties, statutory cancellation rights, or remedies that apply to your purchase.

Order Changes and Cancellations

If you wish to change or cancel an order, contact us promptly at info@jivancollection.com, including your name and order number.

Because our jewelry is made to order, we may be unable to accommodate a voluntary change or cancellation once production has begun. Any specific written terms agreed for bespoke work will also apply, subject to applicable law.

Nothing in this section limits your statutory cancellation rights. Further information is provided in our Return and Refund Policy.

Prices and Billing

Prices and available currencies are displayed on our website. The currency, product prices, discounts, and applicable charges for your order are shown at checkout before you complete your purchase.

We may change prices or introduce, modify, or end promotions. Changes apply to future purchases and do not alter the agreed price of an existing order.

Promotions may have additional conditions, including eligibility requirements, exclusions, and expiration dates, which will be stated with the offer.

Applicable taxes and shipping charges collected by us are shown at checkout. International customs duties, import taxes, brokerage fees, or other charges may be payable separately by the recipient, as explained in our Shipping Policy.

Your bank or payment provider may apply its own currency conversion rates or transaction fees. These charges are determined by that provider.

Shipping and Pickup

Shipping destinations, rates, estimated transit times, insurance, delivery requirements, and atelier pickup arrangements are described in our Shipping Policy.

Transit estimates begin after dispatch and are separate from production time. Carrier disruptions, customs processing, severe weather, public holidays, or other events outside our reasonable control may affect delivery.

Please provide an accurate and complete shipping address. If you notice an error, contact us promptly. Address changes may not be possible once an order has been dispatched.

If your parcel appears lost or your jewelry arrives damaged, please contact us promptly so we can investigate and arrange an appropriate remedy. Nothing in these Terms transfers responsibility to you merely because we have handed the parcel to our carrier or limits your rights regarding delayed, missing, or damaged deliveries.

For atelier pickup, please wait for our email confirming that your order is ready before visiting. Bring your order confirmation and identification.

Returns, Exchanges and Refunds

You may request an eligible change-of-mind return or exchange within 14 calendar days of delivery or pickup. You must contact us within that period; the jewelry does not need to arrive back within those initial 14 days.

Eligibility conditions, exclusions for bespoke and personalized pieces, return instructions, and refund arrangements are set out in our Return and Refund Policy.

For change-of-mind returns, we provide a prepaid return shipping label and deduct its cost from the refund. Original shipping charges are not refundable, except where applicable law requires otherwise. We do not charge a restocking fee.

Our voluntary return conditions do not limit legal warranties or statutory cancellation rights, including applicable rights of consumers in Quebec, the European Union, or the United Kingdom.

Warranty and Aftercare

Your jewelry is covered by any legal warranties and consumer protections that apply to your purchase. These rights apply independently of our voluntary return policy and any additional warranty we offer.

Our additional warranty is described on our Lifetime Warranty page. It supplements and does not replace applicable legal warranties.

Your first ring resize is complimentary. Additional resizing is subject to a fee that varies according to the materials and adjustment required. Please contact us before sending a ring so we can confirm the resizing and shipping arrangements.

Intellectual Property

The content on our website, including text, photographs, graphics, videos, logos, jewelry designs, and website design, is owned by Jewelry Design House by Jivan or used with permission from the relevant rights holders. It is protected by applicable intellectual property laws.

You may browse the website and share links to our pages for personal, non-commercial purposes. Except as permitted by law, you may not copy, reproduce, modify, distribute, sell, or otherwise commercially use our content without our prior written permission.

Purchasing jewelry does not transfer intellectual property rights in its design or in the photographs, drawings, or other materials associated with it.

These Terms do not grant permission to use our name or logo in a way that suggests endorsement, sponsorship, or affiliation without our permission.

Shopify’s trademarks and other third-party intellectual property remain the property of their respective owners.

Optional Tools

Our website may provide access to optional tools or features offered by third-party providers. These tools may be subject to the provider’s own terms and privacy policies, which you should review before using them.

We do not control independently operated third-party tools and cannot guarantee their availability, accuracy, or functionality. To the extent permitted by applicable law, these tools are provided “as is” and “as available.”

Nothing in this section limits our obligations in connection with your purchases or any rights you have under applicable law.

Our website may include links to third-party websites or services, including social media platforms. These websites are operated independently and are subject to their own terms and privacy policies.

A link does not, by itself, imply our endorsement of the website or its content. We do not control third-party websites and are not responsible for their content, availability, or independent practices.

Nothing in this section limits our responsibilities for purchases made through our store or your rights under applicable law.

Relationship with Shopify

Jewelry Design House by Jivan is powered by Shopify, which enables us to provide the Services to you. When you use the Services, your device communicates with Shopify’s systems to deliver the Services.

However, any sales and purchases you make in our store are made directly with Jewelry Design House by Jivan. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Jewelry Design House by Jivan, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Jewelry Design House by Jivan, to the extent permitted by applicable law.

This section does not exclude or limit any obligation or liability of Shopify that cannot lawfully be excluded or limited.

Feedback and Reviews

If you submit a review or other content for public display on our website, you grant us a non-exclusive, worldwide, royalty-free licence to publish, display, and reproduce that content in connection with our store and its promotion. You retain ownership of your content.

Your submissions must reflect your honest experience and must not contain unlawful material, misleading statements, or content that infringes another person’s intellectual property or privacy rights. Any incentives received in connection with a review must be clearly disclosed.

Errors, Inaccuracies and Omissions

We aim to keep our website accurate and current. However, errors or omissions may occasionally occur in product descriptions, prices, promotions, production information, shipping information, or availability.

We may correct errors and update information, subject to applicable law. A correction does not automatically entitle us to cancel an existing order or change its agreed terms.

If an error affects your order, we will contact you to explain the issue and address it in accordance with applicable law. We will not substitute a product, change agreed specifications, or charge a higher price without your agreement.

If an order is lawfully cancelled, we will refund the amounts due within the applicable legal timeframe.

Prohibited Uses

You may use our website and Services only for lawful purposes. You must not:

• Engage in fraud, impersonate another person, or submit false or misleading information.
• Infringe our intellectual property rights or the rights of others.
• Harass, threaten, or abuse customers, employees, or other people through the Services.
• Upload or transmit malicious software, spam, or material intended to disrupt the Services.
• Access another person’s account or collect their personal information without authorization.
• Attempt to bypass security controls, gain unauthorized access, or interfere with the website’s operation.

We may restrict or suspend access where we reasonably believe these Terms have been violated. Any action we take does not remove our obligations regarding existing orders or affect your rights under applicable law.

Agents

This section applies to software or services that act autonomously or semi-autonomously on a person’s behalf to access or interact with our Services (“Agents”).

If you use an Agent, you remain responsible for the actions you authorize it to take, including purchases and submissions of information.

Agents must:

• Not conceal their identity as an Agent or falsely represent themselves as human.
• Respond truthfully to questions about whether an interaction is automated.
• Not complete or bypass CAPTCHAs or other measures intended to distinguish human users from automated tools.

• Stop accessing or interacting with the Services if we request it.

We may restrict or block Agent access, including through technical measures.

Termination

You may stop using the Services at any time. We may suspend or terminate your account or access if you materially breach these Terms, misuse the Services, or where necessary to address security risks or comply with applicable law.

Suspension or termination does not automatically cancel an existing order or remove either party’s obligations relating to payments, production, fulfilment, returns, refunds, or warranties.

Provisions that by their nature should continue after termination will remain in effect, including those concerning intellectual property, rights granted in public feedback and reviews, liability, and dispute resolution.

Disclaimer of Warranties

We take reasonable steps to maintain our website, but we cannot guarantee that it will always be available, uninterrupted, or free from technical errors. To the extent permitted by applicable law, the website and its optional tools are provided “as is” and “as available.”

General educational content is provided for information and does not replace advice tailored to a particular piece or gemstone.

Nothing in these Terms excludes or limits any legal warranty, guarantee, or consumer right that cannot lawfully be excluded. This includes applicable rights relating to product quality, durability, fitness for normal use, conformity with descriptions, and remedies for faulty or misdescribed goods.

Limitation of Liability

Where applicable law permits such a limitation, Jewelry Design House by Jivan will not be liable for indirect or consequential business losses arising from use of the website, such as lost business profits, business opportunities, or anticipated savings.

This limitation does not apply where Quebec’s Consumer Protection Act or another applicable law prohibits us from excluding the consequences of our own acts or those of our representatives.

Nothing in these Terms excludes or limits liability for fraud, intentional or gross fault, bodily or moral injury, or any other liability that cannot lawfully be excluded or limited.

This section does not limit your rights to remedies for faulty or misdescribed products, non-delivery, or other failures to fulfil our obligations under applicable law.

Indemnification

To the extent permitted by applicable law, you agree to indemnify Jewelry Design House by Jivan against third-party claims and reasonable associated costs directly resulting from your unlawful use of the Services, infringement of another person’s rights, or intentional breach of these Terms.

This obligation does not apply to claims arising from our own negligence, misconduct, or breach of these Terms, or merely from your ordinary, lawful use of the Services.

We will notify you promptly of any claim for which we seek indemnification. We will not agree to a settlement that imposes obligations on you without your consent.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the extent necessary. The remaining provisions will continue in effect, unless applicable law requires otherwise.

If any provision conflicts with rights that cannot be waived under applicable law, those rights will apply.

Waiver and Entire Agreement

If either party does not enforce a provision of these Terms, this does not waive their right to enforce it later.

These Terms, the policies referenced in them, and any specific written agreement between you and Jewelry Design House by Jivan concerning an order form the agreement governing your use of the Services and purchases from our store.

If we agree to specific terms in writing for bespoke work, those terms will take precedence over these general Terms where they conflict, subject to applicable law.

Nothing in this section excludes liability for misleading statements, removes binding representations made before purchase, or limits rights that cannot be excluded under applicable law.

Assignment

You may not transfer your rights or obligations under these Terms to another person without our prior written consent, except where permitted by applicable law.

We may transfer our rights and obligations in connection with a sale, merger, or reorganization of our business, provided that the transfer complies with applicable law and does not reduce your rights or protections. We will provide notice or obtain consent where required.

Governing Law and Disputes

These Terms and purchases made through our store are governed by the laws of the Province of Quebec and the federal laws of Canada applicable in Quebec, subject to mandatory consumer protections that apply to you.

Any dispute will be brought before a court with jurisdiction under applicable law. Nothing in these Terms requires you to bring a claim exclusively in Montreal, prevents you from using the courts of your place of residence where permitted by law, or restricts any right to participate in a class action.

Language

These Terms are available in English and French.

Where Quebec law requires, the French version must first be provided to you or made accessible through the French-language online contracting process before you expressly choose to be bound by a version in another language.

If the language versions differ, your rights under applicable law will apply, including any right to rely on the version or interpretation most favourable to you. Nothing in these Terms requires proceedings to be conducted in English or limits your right to use French.

Electronic Communications

We may send transactional and service-related communications electronically, including order confirmations, production updates, shipping notifications, and messages concerning your account, returns, or these Terms.

Please keep your contact information current so we can reach you about your order.

Marketing communications are handled separately in accordance with applicable law and our Privacy Policy. Placing an order does not require you to subscribe to marketing emails.

Changes to These Terms

We may update these Terms from time to time. The current version will be available on this page with its effective date.

Changes apply prospectively and do not alter the terms of existing orders unless you agree or applicable law requires otherwise.

Where required by applicable law, we will notify you of material changes and obtain any necessary consent. Continued use of the Services after updated Terms take effect constitutes acceptance only to the extent permitted by applicable law.
